2-YEAR LIMITATION AND ICBC

In the case of a bodily injury, the Limitation Act gives you two years from the time the accident occurred to commence a lawsuit. If you fail to do so within the two year limitation, you lose your right to commence a lawsuit, and your entitlement to make any claim whatsoever for your injuries disappears on the expiry of the 2 year limitation period. Your right to go to court is critical in forcing I.C.B.C. to settle your case fairly. Our policy is to start your lawsuit well before the limitation expiry date, to protect your rights and to ensure your case is eventually resolved for maximum value.
